Bad estate/charitable planning results sometimes result in protracted litigation and very unhappy people, which can be disastrous events for public relations and economic reasons for those charitable organizations involved and the estate planners who did the work. This presentation will be a deep dive into Martin v. The Ohio State University Foundation, et al., a reported court decision involving the unfortunate aftermath of a failed charitable remainder unitrust/wealth replacement life insurance gift gone bad, in which the charitable beneficiary and several of the clients’ professional advisors were sued for fraudulent misrepresentation and negligent misrepresentation:
- The case and Paul’s presentation will highlight the lessons learned from this case, which involved a plaintiff recovery of in excess of $1,000,000 in a case that can happen to anyone!!!
- Paul will present best practices with a view toward avoiding these types of results in the future.
- Paul will employ his tripartite hermeneutic, or tool of analysis, which he maintains assists in minimizing or even eliminating these types of bad results in the future.
